1. Introduction

This Privacy Policy describes how USOwnedMade ("Company," "we," "us," or "our"), collects, uses, discloses, and protects your personal information when you use the USOwnedMade.com website and marketplace platform (the "Platform"). This policy applies to all users of the Platform, including buyers, manufacturers, and visitors. By using the Platform, you consent to the data practices described in this policy. If you do not agree with these practices, please do not use the Platform.

2. Information We Collect

Information you provide directly: When you register for an account, submit an RFQ, apply as a manufacturer, or contact us, we collect information you voluntarily provide. This includes your name, email address, phone number, business name, business address, job title, website URL, and payment information (processed by our third-party payment processor — we do not store credit card numbers). For manufacturers, we additionally collect business registration documents, proof of US ownership, verification of manufacturing location, certifications, and capability information.

Information collected automatically: When you use the Platform, we automatically collect certain technical information. This includes your IP address, browser type and version, operating system, device type, pages visited and time spent on pages, referring URL, and general geographic location (city/state level, derived from IP address). We collect this information through server logs and cookies.

Information from third parties: We may receive information from business verification services, public records databases, and government registries (such as SAM.gov) in connection with our manufacturer verification process.

3. How We Use Your Information

We use collected information for the following purposes: operating, maintaining, and improving the Platform; facilitating connections and transactions between buyers and manufacturers; processing manufacturer verification applications; processing payments and subscriptions; sending transactional communications (RFQ notifications, bid updates, account alerts); providing customer support; enforcing our Terms of Service; complying with legal obligations; and analyzing aggregate, anonymized usage data to improve our services. We do not use your personal information for automated decision-making or profiling. We will not use your information for any purpose not disclosed in this policy without first obtaining your consent.

4. Information Sharing and Disclosure

Between Platform users: When a buyer and manufacturer are matched for a specific job, we share relevant information between them to facilitate the transaction, including RFQ details, bid information, and contact information necessary for direct communication about the project.

Public directory information: Manufacturer business information that you submit for your directory listing (company name, location, capabilities, certifications, and description) is displayed publicly on the Platform. This information is visible to all visitors.

Service providers: We share information with third-party service providers who perform services on our behalf, including payment processing, email delivery, web hosting, and analytics. These providers are contractually required to use your information only to provide services to us and are prohibited from using it for their own purposes.

Legal requirements: We may disclose your information if required to do so by law, court order, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

We never sell your personal information. We do not sell, rent, lease, or trade your personal information to third parties for their marketing purposes. We do not share your data with data brokers, advertising networks, or marketing firms. This commitment applies to all categories of personal information we collect.

5. Data Security

We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit (TLS/SSL), access controls limiting employee access to personal data, regular security reviews, and secure data storage with our hosting providers. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. We encourage users to maintain strong, unique passwords and to promptly report any suspected security issues.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. If you request account deletion, we will delete your personal information within 45 days, except for information we are required to retain for legal, regulatory, or legitimate business purposes (such as transaction records for tax compliance, which we retain for 7 years as required by the IRS). Anonymized and aggregated data that cannot be used to identify you may be retained indefinitely for analytics purposes.

7. Your Rights

Depending on your location, you may have certain rights regarding your personal information. We honor these rights for all users regardless of location:

Right to access: You may request a copy of the personal information we hold about you.

Right to correction: You may request that we correct inaccurate or incomplete personal information.

Right to deletion: You may request that we delete your personal information, subject to legal retention requirements.

8. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):

Right to know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which it was collected, the business purpose for collecting it, and the categories of third parties with whom we share it.

Right to delete: You have the right to request deletion of your personal information, subject to certain exceptions.

Right to correct: You have the right to request correction of inaccurate personal information.

Right to opt out of sale or sharing: We do not sell your personal information and do not share it for cross-context behavioral advertising purposes. Therefore, there is no need to opt out.

Right to non-discrimination: We will not discriminate against you for exercising your CCPA/CPRA rights.

The Platform uses cookies and similar technologies for the following purposes:

Essential cookies: Required for the Platform to function, including maintaining your session and remembering your preferences. These cannot be disabled.

Analytics cookies: Help us understand how visitors use the Platform so we can improve it. These collect anonymized usage data.

We do not use advertising or tracking cookies. We do not participate in third-party advertising networks. You can control cookie settings through your browser. Most browsers allow you to refuse cookies or alert you when cookies are being sent. Blocking essential cookies may limit your ability to use certain Platform features.

11. Children's Privacy

The Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will promptly delete that information. If you believe we may have collected information from a child under 18, please contact us immediately.

12. International Users

The Platform is operated from the United States and intended for use within the United States. If you access the Platform from outside the US, please be aware that your information will be transferred to, stored, and processed in the United States. By using the Platform, you consent to this transfer.

13. Third-Party Links

The Platform may contain links to third-party websites, including manufacturer websites. We are not responsible for the privacy practices or content of these third-party sites. We encourage you to read the privacy policies of any third-party website you visit.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify users of material changes by posting the updated policy on the Platform, updating the "Last updated" date, and sending an email notification to the address on file for registered users at least 30 days before material changes take effect. Your continued use of the Platform following the effective date of any changes constitutes acceptance of the updated Privacy Policy.
